Policies and Agreements
This policy covers how we use your personal information. We take your privacy seriously and will take all measures to protect your personal information. Any personal information received will only be used to fulfill your order, and may be used for internal analytical purposes. We will not sell or redistribute your information to anyone.
2. Our Copyrights
Graywood Training owns copyrights for instructional materials that you receive from us. You are granted a personal use license for the instructional materials, for the sole purpose of training you in the curriculum for the course(s) that you purchase from us.
3. 100% Pass Guarantee Policy
To qualify for the 100% pass guarantee for PMI Related Exam Prep Classes, you must meet the following criteria:
a. You must attend the entire course, missing no more than one (1) hour.
b. You must send post-exam assessment reports to firstname.lastname@example.org within ten (10) business days of failing the exam. If you fail to pass your exam a total of three (3) times within 120 calendar days following completion of the course, Graywood Training will refund in full your tuition.
c. Above-described refunds will be sent via a paper check mailed to the student within thirty (30) days after Graywood Training receives proof of the third exam failure. Under no circumstances shall the amount refunded be greater than the amount paid for the course.
4. Registration and Payment
a. Your course purchase from us is non-refundable once you receive the course materials. You may transfer your registration for a live training course to a future date on which the course if offered, provided that you notify us of your request at least ten (10) business days prior to the start date for your registered course.
b. If you disrupt a course session, we reserve the right to remove you from the course. In the event you are removed from a course, you will have no right to a refund.
c. All transfer, cancellation, and refund requests must be made in writing via email to email@example.com. In the event that we elect in our discretion to refund a course fee paid by you, the refunded amount will be credited to the credit card that you used for the purchase or a check will be mailed to the your billing address within ten (10) business days after the request is approved.
a. Graywood Training does not Guarantee, represent, or warrant that the use of our services will be uninterrupted or error-free. Our products and services are provided “AS IS” and for your use, without warranties of any kind either express or implied.
b. We do not Guarantee or warrant your eligibility to sit for any exams, as the governing bodies of such exams have that authority at their sole discretion, and make such determinations.
6. Limitation of Liability
a. In no event shall we be liable to you for indirect, special, punitive, incidental, reliance, exemplary, or consequential damages (whether loss of profits, loss of expected savings, or otherwise). In no circumstance shall our total liability to you exceed the amounts paid by you to Graywood Training for course enrollment.
b. The foregoing limitations of liability and disclaimers apply regardless of the form of the action, whether sounding in contract, warranty, strict liability, negligence, or other tort. Because some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, our liability in such jurisdictions shall be limited to the extent permitted by law.
This purchase agreement is between you (the “purchaser” or “student”) and Graywood Training. GWT is a Virginia Company.
8. Governing Law; Exclusive Venue
a. This Agreement and your use of our website and services are governed by and construed in accordance with the substantive law (and not the law of conflicts) of the State of Virginia.
b. You expressly agree that all lawsuits arising under or in connection with your purchases from us, our instructional services, and our relationship with you shall be filed exclusively in the state or federal courts in Virginia. You submit to the exclusive jurisdiction of state and federal courts in Virginia, with respect to any dispute with Graywood Training. You waive any defense or argument claiming that the state or federal courts in Virginia do not represent the preferred venue, lack personal jurisdiction, or are inconvenient or otherwise unsuitable based on the doctrine of forum non conveniens.
